Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern access to and use of Remodel Command HQ (the "Service"), a product of and provided by Dynamic Cursor LLC ("Dynamic Cursor," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a company or other entity, you represent that you have authority to bind that entity, and "you" refers to that entity.

2. Description of Service

Remodel Command HQ is software for residential remodeling companies to manage leads, estimates, projects, scheduling, change orders, invoicing, payments, and customer communication. Features and availability may change as the Service is developed.

3. Accounts

You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for all activity under your account. Notify us promptly at support@remodelcommand.com if you suspect unauthorized access.

4. Your Data

You retain ownership of the business, customer, and project data you submit to the Service ("Customer Data"). You grant us a license to host, process, and display Customer Data solely to provide and improve the Service. You are responsible for having the necessary rights and consents to submit Customer Data, including consent from your own customers where required (for example, before sending them SMS or email notifications through the Service).

5. Payments and Billing

Some features involve processing payments from your customers through third-party payment processors (such as Stripe). Funds you collect through the Service settle directly to your own connected payment account; we do not take custody of customer funds. Subscription fees for the Service itself, if applicable, are billed as described at signup or in a separate order form.

6. Acceptable Use

You agree not to use the Service to:

• Violate any law or the rights of any third party;
• Send unsolicited, misleading, or unlawful communications to customers, including SMS or email sent without proper consent;
• Upload malicious code or attempt to disrupt or gain unauthorized access to the Service;
• Reverse-engineer or resell the Service without our written permission.

7. Third-Party Services

The Service integrates with third-party providers (for example, payment processing, email delivery, SMS delivery, and authentication providers) to deliver its features. Your use of those integrations is also subject to the applicable third party's own terms.

8. Text Messaging (SMS) Terms

Dynamic Cursor account alerts. Dynamic Cursor LLC sends account text messages to Remodel Command users who opt in: billing and subscription notices, security alerts about their account, and replies to their support requests. You opt in by entering your mobile number and checking the unchecked consent box under My text alerts in the Remodel Command app (the box and its exact wording are shown at remodelcommand.com/sms). Consent is not a condition of using the Service or of any purchase; without it, you receive these notices by email.

• Message frequency varies with your account activity.
• Message and data rates may apply.
• To stop: reply STOP (or UNSUBSCRIBE, CANCEL, END, QUIT) to any message. We confirm with one final message and send no more. You can also uncheck the box under My text alerts. Reply START to resubscribe.
• For help: reply HELP, or email support@remodelcommand.com.
• Carriers are not liable for delayed or undelivered messages.
• How we handle your mobile number is described in our Privacy Policy. We never sell or share it for marketing.

Texts from remodeling companies. A remodeling company that uses the Service to text its own customers, subcontractors or suppliers sends those messages under its own business name and its own carrier registration, and is responsible for obtaining each recipient's consent and honoring STOP requests.

9. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate access if these Terms are violated, or as reasonably necessary to protect the Service or other users. Upon termination, provisions that by their nature should survive (including data rights, disclaimers, and limitations of liability) will continue to apply.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Service will be uninterrupted, error-free, or secure at all times.

11. Limitation of Liability

To the maximum extent permitted by law, Dynamic Cursor LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
